310. LAW OF INSURANCE AND CARRIAGE OF GOODS

Maximum : 100 Marks

Answer question No. 1 and any other FIVE questions.

Question No. 1 carries 25 marks and ALL other questions carry 15 marks each.

1. (a) Distinguish between Contribution and Subrogation and examine their application in different kinds of insurance.

(OR)

(b) Explain the basic concepts of insurance with reference to different kinds of insurance.

2.    Elucidate actual total loss and constructive total loss, citing leading cases.

3.    Explain the difference between nomination and assignment of a life policy referring to decided cases.

4.    Premium once paid is not returnable. State the exceptions to the rule.

5.    Explain the various benefits provided under the Employees State Insurance Act, 1948.

6.    What is a charter party ? What are the usual express and implied terms in a charter party ? What is the effect of breach of any of them ?

7.    Explain maritime perils. Insurer is required to compensate the perils insured. - Discuss.

8.    Discuss the liability of the State in regard of railway accident.

9. Write short notes on any TWO of the following:

(a)    Valued and unvalued policy.

(b)    Problem of double insurance.

(c)    Suicided clause in a life policy.

(d)    Cover note and ship.
