1) Discuss the concept of separation of Executive from Judiciary in constitution

of Criminal Courts. Explain in brief functions of Executive Magistrates under

Code of Criminal Procedure.                                                                           [16]

What is the rationale behind inclusion of Maintenance provisions under section

125, in Criminal procedure code? What is the status of grant of such

maintenance as against grants made under other personal laws?

Q2) Trace the evolution of ‘Rights of arrested persons’ brought about by various

landmark judgments of the Supreme Court and amendments made to the

code in view of such judgments.                                                                     [16]

What circumstances justify alterations in ‘Charge’? What procedure must

be undertaken in case such alterations are made in the ‘Charge’?

Q3) Enumerate the circumstances in which release on Bail become mandatory?[16]
