1) Question No. 9 (nine) is compulsory, which carries 20 marks.
2) Out of the remaining attempt any 5 (five) questions, each of such question carries 16 marks .
1. Discuss in detail the historical development and economic background of the concept ‘trade mark’.
2. Explain the procedure for registration of trade marks. What are the effects of registration of trade mark ?
3. Discuss in brief the provisions of Madrid Agreement and its importance.
4. Explain the rights and limitations of registered proprietor of a trade mark.
5. What amounts to infringement of trademark ? Discuss the remedies available against the same.
6. Discuss the law relating to assignment and transmission of trade marks.
7. Discuss the offences and penalties under the Trade Marks Act, 1999.
8. Define the terms ‘mark’ and ‘trade mark’. Explain the various kinds of marks provided under the Act, 1999.
9. Write notes on any two :
a) Paris Convention
b) Duration of Trade Mark
c) Deceptive Similarity
d) Domain Names.
