LM-2016 SOCIAL AND ECONOMIC OFFENCES

Attempt any four questions. All questions carry equal marks.

1.    Clearly bring out distinction between traditional offences and socio-economic offences and need for adopting severe measures in the legislation dealing with latter even to the extent of departing from basic principles of criminal jurisprudence. Critically examine the state of socio-economic offence legislations in India. What further measures would you suggest to improve the existing legal framework of such legislations?

2.    Critically examine the scheme underlying the Dowry Prohibition Act, 1961 to deal with the menace of dowry in India. What further legislative measures have been taken to provide remedy, both civil and criminal, to deal with different dimensions of the problems in the Indian society arising from the menace of demand of dowry?

3.    Critically examine the sentencing policy adopted by the legislature and also the courts while dealing with the socio-economic offences and the impact of such policies in inhibiting people from committing such offences.

4.    What do you understand by the terms white collar crime and socio-economic crime bringing clearly the distinction between the two with reference to the discussions in various Law Commission Reports and judicial decisions?

5.    Write short notes on any two of the following:

(i)    Liability of directors for corporate frauds

(ii)    A critical evaluation of the working of the Prevention of Corruption Act, 1988

(iii)    Critical evaluation of the Wanchoo Committee Report on Direct Taxes.

6.    The Food Adulteration Act... is a welfare legislation to prevent health hazards by consuming adulterated food ... It is a social evil and the Act inhibits commission of the offences under the Act.

Critically examine the objects, nature of the liability and the scheme underlying the said legislation and also the approach of the Indian judiciary towards this legislation.
