1.    Attempt briefly any four of the following :

(i)    Distinguish between theft and extortion.

(ii)    Discuss the ingredients of sudden fight as a partial defence to the offence of murder.

(iii)    Distinguish between kidnapping from lawful guardianship and abduction.

(iv)    Explain the doctrine of transference of malice.

2.    Mita, aged 17 years and 10 months, was a student of B.Sc. first year in one of the reputed colleges of University of Delhi. She developed an intimate relationship with Salim, her classmate. Apprehending that her orthodox family would never permit her inter-

religious marriage with Salim, Mita telephoned Salim to discuss the issue. Salim told Mita that the doors of his house were always open for her and his parents would treat her like their own daughter. That night, when her family members were asleep, Mita went to Salims house and spent the night there. On a complaint made by Mitas parents, Salim is charged with the offence of kidnapping Mita from lawful guardianship. Decide citing judicial precedents.

3. Amit went into a state of shock when he learnt about his wifes extra-marital affair with his best friend, Sumit. Amit locked himself up in a room and did not have dinner that night. Next morning he went to Sumits house and shot him dead with his licensed revolver, without uttering a word. Amit is being prosecuted for Sumits murder. Decide.

(a)    X, a gatekeeper at a manned railway crossing, went away for his lunch without closing the gate. A bus crossing that railway track sometime later, was hit by a goods train and six passengers died as a result. Discuss the criminal liability, if any, of X and the bus driver.

(b)    Reema was being continuously harassed by her husband Rohit for not bringing sufficient dowry. On several occasions, Rohit told Reema that he would get rid of her and get remarried to some rich girl. One day Rohit strangulated Reema with

* a rope and believing her to be. dead, set her on

fire. The post mortem report revealed that Reema died due to burn injuries and not due to strangulation. Examine Rohits liability for causing Reemas death.

7. (a) A, a Life Insurance Corporation agent, collected the premium amount of the policy from B, the policy holder. Instead of depositing the money with the Corporation, A used the money to buy a scooter for himself. For what offence can A be prosecuted ?

(b) E threatens to publish a defamatory libel concerning Z, unless Z gives Rs. 50,000 to him. Z gives the money to E. What offence, if any, has been committed by E ?

8. (a) I, falsely pretending to be an income-tax official, entered Rs house and told R that he owes some money to the income-tax department. R paid the money to I. What offence has been committed by I ?

(b) Nina and her friend Seema used to exchange books on a regular basis. One day Nina entered Seemas library in Seemas absence and picked up a book and took it to her home for reading. Is Nina guilty of any offence ? Would your answer be different if after going through the book Nina likes it and decides to retain it to enrich her own collection on books ?
