Note: There are three sections in the question paper. Section A is compulsory. Attempt any two questions from Section B and two questions from Section C. All questions carry equal marks.

(a) How do you define contract?

(b) What are the essential elements of a valid contract?

(c) What are insurance contract?

(d) State the procedure to invite tenders?

(e) Differentiate between liquidated damages and penalty.

(f) What do you understand by the breach of contract?

(g) Enumerate the laws and acts related to construction industry.

(h) Differentiate between arbitration and litigation.

(i) State essentials of an arbitration agreement.

(j) Enlist the common disputes in construction contract (10x2)=20

Section B

Q-2. (a) How contracts are classified? Describe two main types of construction contract. (10)

(b) "A particular type of contract is normally suitable for a particular situation." Comment and describe with suitable example. (10)

Q-3. (a) Describe the process of preparation of tender documents. Discuss the general tendering procedure adopted by a construction organization. (10)

(b) Why is prequalification of contractor necessary? Give its advantages and disadvantage's. (10)

Q-4. (a) "The Indian Contract Act, 1872 is not a complete code dealing with all branches of the law of contract." Discuss in brief. (10)

(b) What is retention money? What is the purpose of retention money?

(a) Why specifications are necessary in construction. Detail out the utility of specifications in a class A construction in comparison to a given contract. (10)

(b) What is standard specification? Write standard specification for some important construction work related to a building. (10)

Q-6.(a) Discuss the provisions of the company law/Factories Act, 1948 with regards to health, safety and welfare of the workers. (10)

(b) Define wages under the Payment of Wages Act, 1936. What is the object of the Minimum Wages Act, 1948? (10)

Q-7. (a) What do you understand by industrial disputes as defined in the Industrial Disputes Act, 1947? What is the procedure for settlement of industrial disputes under the act? (10)

(b) What is a contract of insurance? Explain the fundamental principle of insurance. (10)
