211. INDUSTRIAL RELATIONS LAW-II

1. a) “The causes of industrial disputes are multidimensional. The state has played a critical role through its policies and legislations towards achieving harmonious industrial relations -Comment”

b) “Industrial relations in India have been shaped largely by principles and policies evolved through tripartite consultative Machinery at the industry and national level -Discuss”

2. Critically examine the definition of ‘Industry’. An amendment was made to sec. 2(f) of the IDACT, 1947 in the year 1982, but was not enforced. In view of this examine the legal position of the term industry.

3. Define ‘Retrenchment’ and discuss the legal regulations relating to retrenchment as discussed by Supreme Court.

4. What is “industrial dispute” and under what circumstance does the individual dispute become industrial dispute?

5. What are the different authorities established under the ID Act, 1947 for settlement of industrial disputes? Examine the jurisdiction, powers and functions of these authorities.

6. Discuss the scope of the discretion vested in the improper Government in the matter of reference of industrial disputes under part 10 of the Industrial Disputes Act, 1947 and examine the extent to which an order of reference is amenable to Judicial Review.

7. “The object of S.33 is to protect workman concerned in the dispute against victimisation by the employer” – discuss.

8. “An industrial worker has the right to know the terms and conditions under which he in employed and the rules of discipline which he in expected to follow” –Explain.

9. Write short notes on any 2 of the following:
a) Domestic inquiry
b) Lay-off
c) Award
